As cannabis cultivation and sales continue to expand across California, so does the need for proper cannabis waste disposal. Licensed businesses are legally required to manage cannabis waste in strict accordance with state regulations, including Division 30 of the Public Resources Code.
Improper disposal isn’t just a compliance issue; it’s also a public health and environmental risk. This guide outlines what qualifies as cannabis waste, why it’s regulated, how to dispose of it safely, and how MedWaste Management can help you stay compliant.
Why Is Cannabis Waste Regulated?
California has the largest legal cannabis market in the United States. The state has therefore implemented strict laws surrounding the disposal of cannabis waste to help protect public safety and monitor the legal supply chain.
Leftover cannabis material, whether from dispensaries, growers, or manufacturers, can be tempting to unauthorized individuals if it is not properly secured. In worst-case scenarios, this waste may end up in the hands of children or be consumed unsafely. Regulation helps prevent this by requiring secure disposal and documentation of all cannabis waste.
Disposal of cannabis waste falls within cannabis tracking, in which every stage of the product’s life cycle is strictly monitored. Waste reporting helps the state verify product output, ensure that licensees are held accountable, and, importantly, reduce black-market activity.
You Cannot Use or Sell Cannabis Waste
Under no circumstances can cannabis waste be sold, reused, or disposed of in traditional trash bins or open dumpsters. Instead, it must be placed in secure pharmaceutical waste containers that are located in restricted areas of your licensed premises. These areas must not be accessible to the public and should only be entered by authorized employees or your licensed waste hauler.
What Counts as Cannabis Waste?
Cannabis waste refers to any cannabis-containing material or related product that is no longer viable for use. Common examples include:
- Expired flower, oils, tinctures, or edibles
- Contaminated or otherwise unusable cannabis products (e.g., exposed to pesticides or mold)
- Topical cannabis products that have expired
- Trim waste from cultivation
- Growing media (e.g., soil, rockwool, clay pebbles)
- Packaging and containers contaminated with cannabis residue
- Unused consumables like vape pens, capsules, or grinders
Best practice: If an item contains any trace of cannabis or has come into contact with cannabis, it should be treated as regulated cannabis waste.
Proper Cannabis Waste Disposal Methods
All cannabis waste must be securely stored on-site in designated waste receptacles before being transported to an approved disposal facility. A pharmaceutical waste container is typically required for compliant storage. These are included with our service at no extra cost, or are available for purchase separately.
In many cases, cannabis waste must be rendered unrecognizable or unusable before disposal. In some states (like Colorado), this step must happen before the waste leaves your premises. Methods include:
- Mixing cannabis waste with a non-consumable solid (e.g., soil, detergent, food waste) until the mixture is at least 50% non-cannabis
- Grinding and incorporating cannabis material with other waste until the product cannot be separated or consumed
Your local regulations will dictate who is responsible for this step, either your business or your licensed disposal company.
Disposing of Cannabis Waste: Three Legal Options
1. Self-Hauling Cannabis Waste
Licensed businesses may transport their own cannabis waste to approved facilities, including:
- Permitted solid waste facilities
- Composting or in-vessel digestion operations
- Licensed chip and grind operations
- Transfer/processing centers
Only the licensee or authorized employees may transport the waste. Each delivery must be accompanied by documentation, such as a certified weight ticket or receipt from the facility to prove legal disposal.
2. Hiring a Licensed Cannabis Waste Hauler
Working with a certified cannabis or medical waste disposal provider (like MedWaste Management) streamlines the entire process. We:
- Collect and transport waste in compliance with California regulations
- Provide pharmaceutical-grade waste containers
- Ensure secure handling and tracking
- Deliver the required documentation for your records, including:
- The name of the waste hauler
- Date and time of pickup
- Waste weight or volume documentation
- Confirmation of delivery to a licensed facility
This option reduces your regulatory burden and ensures nothing slips through the cracks.
3. Composting Cannabis Waste On-Site
If you prefer to compost cannabis waste at your licensed facility, you must follow Title 14, Chapter 3.1 of the California Code of Regulations. This method requires compliance with environmental, health, and safety standards for organic waste processing.
Some licensed waste haulers, including MedWaste Management, also partner with licensed composting facilities. These facilities turn cannabis waste into compost while reducing environmental impact. We handle the pickup and transport, and the composting facility provides all legally required documentation.
